Terms of Service

1. Acceptance

By using HealthPhin, you agree to these Terms of Service. If you do not agree, please do not use the service. HealthPhin is operated by PhinLabs (Markus Egolf), Glärnistr. 52b, 8712 Stäfa, Switzerland. Swiss law applies. For EU consumers, mandatory consumer protection laws of your country of residence apply additionally.

2. Service Description

HealthPhin is a web-based health tracker with supplement tracking, blood work analysis, training logging, nutrition tracking, journal, and AI-powered insights. It is NOT a medical device, healthcare provider, or substitute for professional medical advice. Features depend on your chosen plan (Free, Basic, Pro, Pro AI).

3. Minimum Age

You must be at least 16 years old to use HealthPhin. By registering, you confirm that you meet this age requirement. HealthPhin processes health data — protecting minors is our highest priority (Art. 8 GDPR, Art. 7 nDSG).

4. No Medical Advice

HealthPhin does NOT provide medical advice, diagnoses, or treatment recommendations under Swiss medical law (MedBG), the Therapeutic Products Act (HMG), or equivalent EU directives. All analytics and AI outputs are for informational and self-reflection purposes only. AI-based blood work interpretations and supplement analyses are observations, not diagnoses. Always consult a qualified healthcare professional for medical decisions.

5. Account & Usage Rules

You are responsible for maintaining the security of your account credentials. One account per person. Sharing accounts is not permitted. You agree not to: (a) use false identities, (b) use automated tools for scraping or data mining, (c) reverse engineer the software, (d) distribute unlawful content via community features. Violations may result in account suspension.

6. Health Data

You acknowledge that HealthPhin processes sensitive health data (Art. 9 GDPR). By using the service, you provide explicit consent to the processing of your health data as described in our Privacy Policy. You can export and delete all your data at any time.

7. Pricing & Payment

HealthPhin Free is permanently free. Paid plans (Basic, Pro, Pro AI) are billed monthly in Swiss Francs (CHF). Current prices are listed on the pricing page. Price changes are announced at least 30 days in advance via email. Existing subscriptions are only affected after the current billing period ends. Beta pricing (30% discount) remains valid for early access users as long as their subscription stays active.

8. Right of Withdrawal

Under Swiss law (Art. 40a-f CO) and EU distance selling regulations, you have the right to withdraw within 14 days of purchase without giving reasons. Send your withdrawal to [email protected]. Refunds are processed within 14 days. The right of withdrawal expires if you have expressly consented to immediate service execution before the withdrawal period ends.

9. Cancellation

You may cancel your subscription at any time, effective at the end of the current billing period. After cancellation of a paid plan, you retain access to the Free plan. Full account deletion permanently removes all data within 30 days. Data export is available at any time (Art. 20 GDPR).

10. Intellectual Property

All rights to the software, design, and content of HealthPhin belong to PhinLabs. You receive a non-exclusive, non-transferable license to use HealthPhin for the duration of your subscription. AI-generated analyses may be used for personal purposes but may not be commercially redistributed. Your own input data (health data, journal) belongs to you.

11. Limitation of Liability

HealthPhin is provided "as is". We are not liable for health decisions made based on HealthPhin analyses, erroneous or incomplete AI-generated interpretations (especially blood work analyses), data loss due to force majeure, or service interruptions. Liability for intentional and grossly negligent conduct remains unaffected.

12. Changes to Terms

We reserve the right to modify these terms. Material changes will be communicated at least 30 days before taking effect via email. If you do not object within this period, the new terms are deemed accepted. In case of objection, you may terminate the contract effective on the date the new terms take effect.

13. Governing Law & Dispute Resolution

These terms are governed by Swiss law. Jurisdiction is Zurich, Switzerland. For EU consumers, mandatory consumer protection laws of your country of residence apply additionally. The European Commission provides an Online Dispute Resolution (ODR) platform: ec.europa.eu/consumers/odr.

14. Severability

If any provision of these terms is found to be invalid, the remaining provisions shall remain in full force and effect. The invalid provision shall be replaced by a valid provision that most closely reflects the economic purpose of the invalid provision.
